Longshore & Harbor Workers' Compensation Act

Maritime workers, including but not limited to longshore, harbor workers, shipbuilders, those on navigable waters or on adjoining areas, are covered under the Federal Longshore and Harbor Workers’ Compensation Act (L&H Act).

Filing a L&H Act claim
Employers’ First Report of Injury or Occupational Illness must be filed within 10 days of the injury or awareness of it, if the employee loses one or more shifts. An $11,000 fine is possible for failure to file on time. Medical Treatment
Employers must furnish medical, surgical and other treatment, nurse and hospital services, medicine, crutches and apparatus for as long as required.

There is a three-day waiting period for initial payment of benefits.

Compensation for the waiting period will be paid if the employee’s disability extends beyond the 14th day.
